Welcome to Interview on Demand! Before you enter the Site or application (the “Site”) or use any of the Interview on Demand services (the “Service”), it is important that you carefully review these Terms of Service (the “Terms”). In addition, specific pages on the Site may set out additional terms and conditions, all of which are incorporated by reference into the Terms. Terms may be changed or updated at any time, but you can always find the most recent version here. In the case of inconsistencies between these Terms and information included in other materials these Terms will always control.
By entering and using the Site, you indicate that you accept the Terms and that you agree to be bound by and subject to them. Acceptance of the Terms creates a binding legal agreement between you and Interview on Demand that you will use the Service only in a manner that is consistent with the Terms. If you have questions about the Terms, please contact us at legal@InterviewOnDemand.com. Your use of the Site and its services (together, the "Service") is entirely conditioned on and subject to your compliance with the Terms. If you do not agree with the Terms, do not proceed to access the Site or use the Service.
1. Terms of Service Use The Interview on Demand site (the "Site"), which you have access to by means of an email invitation from a “Hiring Company”, hereafter referred to as the “Service” enables the Hiring Company to interview you the “Candidate” using questions provided by the Hiring Company. During the on-line interview, you will record audio and video (the “Content”), which the Site will make available to the Hiring Company. The Interview on Demand service use (referred to as "Service Use") is only available to you if you at least 18 years of age. In addition, you agree that any information you supply to Interview on Demand is true, accurate, current and complete (whether by questionnaires, surveys, registration forms or other informational requests).
2. Candidate Conduct The Service is specifically dedicated to enable Hiring Companies to interview Candidates using Internet technologies and using questions provided by the Hiring Companies. To this end, we require you not to use this Service to process, digitize, post, upload, store or share Prohibited Content. Prohibited Content includes but is not limited to any of the following types of Content:
a. Video and/or audio which is recorded while using the service we believe is abusive, deceptive, pornographic, obscene, defamatory, slanderous, offensive, or otherwise inappropriate.
b. Copyrighted material that is used without the express permission of the owner.
c. Content that violates or encroaches on the rights of others,
d. Content or other material that contains viruses, worms, corrupt files, Trojan horses and other forms of corruptive code or any other content, which may compromise the Interview on Demand Service.
e. Content that advocates illegal activity.
f. Content that harms minors in any way.
g. Any links to the above.
Interview on Demand has the sole discretion to determine whether Content is Prohibited Content, and any Content submitted to the Service may be subject to examination from time to time. You acknowledge that although Interview on Demand does not and will not examine and review all Content submitted or transmitted to the Service, Interview on Demand has the absolute right (but not the obligation) to delete, move, and edit materials for any reason, at any time, without notice.
Notwithstanding the above, when you access the Site and/or use the Service, you acknowledge and agree that all Content (whether private or public) that is posted and stored on the Site is the sole responsibility of the person who submitted the Content. In no event shall Interview on Demand, LLC ("Interview on Demand") (including its officers, directors, employees, affiliates and agents) be liable for claims of any nature, whether direct or indirect, arising from or related to any Content made available on or through the Service, including (without limitation) errors or omissions in such Content, and loss or damages incurred as a result of use of such Content.
You agree and acknowledge that Interview on Demand, in its sole discretion, may terminate your Service Use (or any part thereof) or use of the Service, and remove and discard any Content including, but not limited to, any and all Content, information, communications, or any other content within the Service, at any time, without notice, for any reason, including but not limited to:
a. Conduct violating these Terms or other policies or guidelines set forth by Interview on Demand elsewhere on the Site;
b. Conduct that Interview on Demand believes is harmful to other Interview on Demand users, the business of Interview on Demand, the business of the Hiring Company or other third party information providers; and
c. Conduct that violates the letter or spirit of these Terms. Further, you agree that Interview on Demand shall not be liable to you or any third-party for any termination of your access to the Service.
The Site and the Service are protected by U.S. and international copyright laws and by other applicable laws. You agree that any use of this Site shall only be for the purpose of responding to a legitimate invitation for an interview from a Hiring Company. You agree that you will not reverse engineer or decompile any part of the Site for any purpose whatsoever including but not limited to construction of a competitive site or service.
3. Authorization to Use Content In order for us to make your interview available to the Hiring Company, we need the rights to make use of the video and audio which you record using the Service (in accordance with and subject to these Terms). Accordingly, as a condition to your Service Use, you hereby grant Interview on Demand a perpetual, universal, nonexclusive right to copy, display, modify, transmit, make derivative works of and distribute any Content transmitted or provided to the Service by you, solely for the purpose of delivering the Content to the Hiring Company for their review. Further, you acknowledge that the Hiring Company has the right to forward the Content without restriction for the purpose of evaluating you for a job. You represent and warrant to Interview on Demand that you are the person represented in the Content.
4. No Additional Rights of Discrimination You agree that using the Service, as it relates to your rights of claiming discrimination against you, is no different than a face-to-face or in-person interview. You agree that USING THIS SERVICE BENEFITS YOU BY ENABLING YOU TO INTERVIEW FOR A JOB for which you may or may not have otherwise had the opportunity to interview. your rights to claim discrimination against Interview on Demand and/or the Hiring Company are neither increased nor decreased because you interviewed using the Service.
5. No Unauthorized Forwarding of Content You agree that you will not forward the Content or any part of the Content except as you are specifically authorized through the user interface of the Service. You further agree that you will not forward the Content to any public site such as YouTube, Monster or any other site unless explicitly authorized by the Service.
6. No Resale of Service You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, use of the Service, or access to the Service for any commercial purposes other than to respond to the email invitation which you have been sent.
7. Privacy Policy We respect your privacy and have taken specific steps to protect it. Please see our Privacy Policy. Even though we take steps to request that Hiring Companies treat your Content confidentially, we cannot guarantee that they will do so. By using the Service, you and you alone assume all risk with respect to the possibility that the Content is not treated confidentially and you release both Interview on Demand and the Hiring Company of any and all liability in the event that the Content used in a way that brings harm to you. Therefore, you should only respond to interview requests from Hiring Companies that you have researched and believe to be legitimate and professional in how they handle matters of employment confidentiality.
8. Warranty Disclaimer YOU AGREE THAT YOUR USE OF THE INTERVIEW ON DEMAND SERVICE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, INTERVIEW ON DEMAND, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF. INTERVIEW ON DEMAND MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SITE'S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS SITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE INTERVIEW ON DEMAND SERVICE. INTERVIEW ON DEMAND DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE INTERVIEW ON DEMAND SERVICE OR ANY HYPERLINKED SITE OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND INTERVIEW ON DEMAND WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.
9. Limitation of Liability IN NO EVENT SHALL INTERVIEW ON DEMAND, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE INTERVIEW ON DEMAND SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
YOU SPECIFICALLY ACKNOWLEDGE THAT INTERVIEW ON DEMAND SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
The Site is controlled and offered by Interview on Demand from its facilities in the United States of America. Interview on Demand makes no representations that the Interview on Demand Service is appropriate or available for use in other locations. Those who access or use the Interview on Demand Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.
10. Indemnity You agree to defend, indemnify and hold harmless Interview on Demand, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Interview on Demand Service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Interview on Demand Service.
11. Ability to Accept Terms of Service You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. If you are under 18 years of age, then please do not use the Interview on Demand Service.
12. Assignment These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Interview on Demand without restriction.
13. General You agree that: (i) the Interview on Demand Service shall be deemed solely based in the State of Georgia; and (ii) the Interview on Demand Service shall be deemed a passive website that does not give rise to personal jurisdiction over Interview on Demand, either specific or general, in jurisdictions other than Georgia. These Terms of Service shall be governed by the internal substantive laws of the State of Georgia, without respect to its conflict of laws principles. Any claim or dispute between you and Interview on Demand that arises in whole or in part from the Interview on Demand Service shall be decided exclusively by a court of competent jurisdiction located in Fulton County, Georgia. These Terms, together with the Privacy Policy at Privacy Policy and any other legal notices published by Interview on Demand on the Site, shall constitute the entire agreement between you and Interview on Demand concerning the Interview on Demand Service. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and Interview on Demand's failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. Interview on Demand reserves the right to amend these Terms of Service at any time and without notice, and it is your responsibility to review these Terms of Service for any changes. Your use of the Interview on Demand Service following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred. Titles are for convenience only.
14. Modification of Terms
You agree that Interview on Demand reserves the right to amend the Terms at any time, for any reason, and without notice, including the right to terminate the Service or any part of the Service. Any amendments or modifications made by Interview on Demand shall be prospective only.

You agree that you will not reverse engineer or decompile any part of the Site for any purpose whatsoever including but not limited to construction of a competitive site or service.

Authorization to Use Content In order for us to make your interview available to the Candidate, we need the rights to make use of the interview questions and other information you provide when using the Service (in accordance with and subject to these Terms). Accordingly, as a condition to your Service Use, you hereby grant Interview on Demand a perpetual, universal, nonexclusive right to copy, display, modify, transmit, make derivative works of and distribute any Content or other information transmitted or provided to the Service by you, solely for the purpose of delivering your interview to legitimate Candidates and obtaining their on-line interview and delivering it to you. You acknowledge that you will take all reasonable measures to restrict distribution of the Content to only those individuals who have a legitimate need to review the Content for the purpose of evaluating the Candidate for a job. You represent and warrant to Interview on Demand that you are the person who Registered on the Site.
4. No Use for Discrimination YOU AGREE THAT YOU WILL USE THE SERVICE IN A MANNER SIMILAR TO A FACE-TO-FACE INTERVIEW WITH RESPECT TO YOUR HUMAN RESOURCE POLICIES TO ENSURE THAT CANDIDATES ARE NOT DISCRIMINATED AGAINST.
5. No Unauthorized Modification or Forwarding of Content You agree that you will not forward the Content or any part of the Content except to people who have a legitimate role or interest in hiring the Candidate. You further agree that you will not forward the Content to any public site such as YouTube, Monster or any other site unless explicitly authorized by the Service.
6. No Resale of Service You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, use of the Service, or access to the Service for any commercial purposes other than to create interviews, send interviews and review the results of the interviews for the purpose of evaluating candidates for potential employment or hire.

8. Warranty Disclaimer YOU AGREE THAT YOUR USE OF THE INTERVIEW ON DEMAND SERVICE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, INTERVIEW ON DEMAND, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF. Limitation of Liability IN NO EVENT SHALL INTERVIEW ON DEMAND, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE INTERVIEW ON DEMAND SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
YOU SPECIFICALLY ACKNOWLEDGE THAT INTERVIEW ON DEMAND SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
THE SITE IS CONTROLLED AND OFFERED BY INTERVIEW ON DEMAND FROM ITS FACILITIES IN THE UNITED STATES OF AMERICA. INTERVIEW ON DEMAND MAKES NO REPRESENTATIONS THAT THE INTERVIEW ON DEMAND SERVICE IS APPROPRIATE OR AVAILABLE FOR USE IN OTHER LOCATIONS. THOSE WHO ACCESS OR USE THE INTERVIEW ON DEMAND SERVICE FROM OTHER JURISDICTIONS DO SO AT THEIR OWN VOLITION AND ARE RESPONSIBLE FOR COMPLIANCE WITH LOCAL LAW.
10. Indemnity YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS INTERVIEW ON DEMAND, ITS PARENT CORPORATION, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS, FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS OR DEBT, AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY'S FEES) ARISING FROM: (I) YOUR USE OF AND ACCESS TO THE INTERVIEW ON DEMAND SERVICE; (II) YOUR VIOLATION OF ANY TERM OF THESE TERMS OF SERVICE; (III) YOUR VIOLATION OF ANY THIRD PARTY RIGHT, INCLUDING WITHOUT LIMITATION ANY COPYRIGHT, PROPERTY, OR PRIVACY RIGHT; OR (IV) ANY CLAIM THAT YOUR CONTENT CAUSED DAMAGE TO A THIRD PARTY. THIS DEFENSE AND INDEMNIFICATION OBLIGATION WILL SURVIVE THESE TERMS OF SERVICE AND YOUR USE OF THE INTERVIEW ON DEMAND SERVICE.
11. Ability to Accept Terms of Service You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. If you are under 18 years of age, then please do not use the Interview on Demand Service.
12. Assignment These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Interview on Demand without restriction.
13. General You agree that: (i) the Interview on Demand Service shall be deemed solely based in the State of Georgia; and (ii) the Interview on Demand Service shall be deemed a passive website that does not give rise to personal jurisdiction over Interview on Demand, either specific or general, in jurisdictions other than Georgia. These Terms of Service shall be governed by the internal substantive laws of the State of Georgia, without respect to its conflict of laws principles. Any claim or dispute between you and Interview on Demand that arises in whole or in part from the Interview on Demand Service shall be decided exclusively by a court of competent jurisdiction located in Fulton County, Georgia. These Terms, together with the Privacy Policy at Privacy Policy and any other legal notices published by Interview on Demand on the Site, shall constitute the entire agreement between you and Interview on Demand concerning the Interview on Demand Service. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and Interview on Demand's failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. Interview on Demand reserves the right to amend these Terms of Service at any time and without notice, and it is your responsibility to review these Terms of Service for any changes. Your use of the Interview on Demand Service following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred. Titles are for convenience only.
14. Modification of Terms You agree that Interview on Demand reserves the right to amend the Terms at any time, for any reason, and without notice, including the right to terminate the Service or any part of the Service. Any amendments or modifications made by Interview on Demand shall be prospective only.
